2009 Stallion Breeding Contract

I hereby request a reservation for the below-named mare to the AQHA stallion:
IMA PLAYBOY DOCOLENA , (Reg. No.4083223 ) with the following terms:  

1. Mare owner agrees to pay a stud fee of $750.  In addition, a $100 non-refundable booking fee is payable with this completed and signed contract. The stud fee, mare care, and any vet fees must be paid in full when the mare is picked up after breeding. A copy of the mare’s registration papers and current coggins are to accompany the contract and booking fee.

2. Mare owner agrees to pay $9 per day mare care and $12 per day care, if accompanied by foal, due at the time of pick up along with the balance of the breeding fee. Mare owner also agrees that any mare not being picked up within 30 days after notification of the mare’s being bred authorizes stallion owner to take whatever action necessary to recover breeding fees, mare care fees, etc., including the sale of the mare.

3. All vet bills are the obligation of the mare owner and will be directly billed to the mare owner by the Veterinarian making the farm trips. These fees could include but are not limited to: palpations, shots, emergencies, etc.

4. The mare offered for breeding will be sound for such, and free from infection or disease.  A clean uterine culture is highly recommended. Vet checked for breeding dates is also highly recommended.

5. Mare owner agrees that this contract applies only to the mare presented for breeding.  A Breeder’s Certificate will be issued to the mare owner after the foal is born and all contractual obligations are met.

6. Live Foal Guarantee (LFG):  It is agreed that a live foal will result from this mating.  Live foal shall be defined as the foal able to stand and nurse on its own. The LFG will only apply if written certification is provided by a licensed veterinarian that (a) the mare in question was checked in foal initially by day 21; (b) the mare was properly vaccinated for Rhinopneumonitis, (c) the mare remains in the possession of the mare owner, (d) mare owner notifies stallion owner of the death/miscarriage of the foal with in 10 days in writing.

7. If the mare proves barren, aborts her foal, or if the foal is stillborn, with veterinarian certification, the stallion owner will rebreed up to July 31st of 2010. If the mare fails to settle or slips after her third heat cycle, the mare must have a diagnostic evaluation at mare owner’s expense to determine her suitability for breeding. If she proves suitable, stallion owner will allow up to two more breeding attempts the following year. If she proves unsuitable, mare owner must document that original mare is not in foal and a substitute mare will be allowed. 

8. Should the mare die, or become unfit to breed, another mare may be substituted with the stallion owner’s consent.

9. Mare owner assumes the unavoidable risk inherent in all horse-related activities.  Mare owner agrees to indemnify and hold harmless the stallion owner, agents, veterinarians and technicians for death, sickness or inconsequential damages to the mare.

10. Signing this contract indicates that I have read and fully understand all of the terms and conditions outlined herein, and there is no other agreement, verbal or implied, unless specifically stated in writing.  Contract governed by the laws of the Commonwealth of Kentucky.
